1. Introduction
Maestrum is a desktop software application (the “Software”) operated by Henrique Perez Gomes da Silva, registered in Brazil under CNPJ 56.873.358/0001-83 (“we”, “our”, “us”). By downloading, installing, accessing, or using Maestrum, you agree to be bound by these Terms & Conditions. If you do not agree with these Terms, do not use the Software.
2. Product Description
Maestrum is a gesture-based creative software tool for macOS only. The Software uses your device’s webcam locally to detect hand gestures using Electron and the Google MediaPipe library.
Important:
- Webcam data is processed entirely on-device
- No images, videos, or webcam data are recorded, stored, or transmitted
- No webcam data is sent to our servers or to third parties
Internet connectivity is required only for license validation and not for webcam or gesture processing.
3. License Grant
Upon successful purchase, you are granted a non-exclusive, non-transferable, non-sublicensable license to install and use Maestrum.
- License type: One-time payment
- Usage: 1 user, up to 2 devices
The license includes bug fixes and minor updates. Major version upgrades (significant new features or version jumps) may require an additional paid upgrade.
4. Restrictions
You may not:
- Reverse engineer, decompile, or disassemble the Software
- Modify, copy, distribute, resell, rent, lease, or sublicense the Software
- Use the Software for unlawful or abusive purposes
5. Refunds
Refunds are governed by our Refund Policy, which forms an integral part of these Terms. Please refer to the Refund Policy for detailed information.
6. Intellectual Property
All rights, title, and interest in and to the Software, including source code, visual design, trademarks, and documentation, remain the exclusive property of Maestrum.
7. Disclaimer of Warranties
The Software is provided on an “AS IS” and “AS AVAILABLE” basis, without warranties of any kind, whether express or implied, including but not limited to fitness for a particular purpose or non-infringement.
8. Limitation of Liability
To the maximum extent permitted by applicable law, Maestrum shall not be liable for any indirect, incidental, consequential, or special damages arising out of or related to the use or inability to use the Software.
9. Termination
We reserve the right to suspend or terminate the license if these Terms are materially breached. Upon termination, you must cease all use of the Software and uninstall it from your devices.
10. Governing Law
These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law principles.
